MINI ROOFTOPS PRE-ORDER PROGRAM TERMS AND CONDITIONS

Welcome to the MINI Roof Decals Program ("Pre-Order Program"). Before you pre-order your vehicle, you must carefully review and accept the Terms and Conditions below. Under the Pre-Order Program, a MINI vehicle is available for an early order to customers who complete the Pre-Order Process (as outlined below).
MINI USA, a division of BMW of North America, LLC, offers you an opportunity to pre-order a MINI vehicle from an authorized, participating MINI Dealer ("Dealer"). By completing the Pre-Order Process, you will be pre-ordering a MINI vehicle with model year and options to be confirmed at the time of configuration subject to availability and production restrictions. The vehicle you configure is referred to "as the Vehicle". This Pre-Order Program offers a unique opportunity to be among the first to order a MINI and finalize a price through your Dealer as described in the terms below.

The Pre-Order Program is NOT a vehicle purchase. You will still be required to contact an authorized MINI Dealer to discuss final transaction pricing and trade-in if relevant, arrange any necessary financing, and complete your purchase through the Dealer. Your Pre-Order secures your approximate priority for taking delivery of your vehicle. Participation in the Pre-Order Program does not guarantee you a vehicle delivery.
Your Pre-Order does NOT guarantee a set price for the Vehicle. PLEASE BE AWARE THAT DEALER SETS THE ACTUAL PRICE WHICH MAY DIFFER FROM THE MANUFACTURERS SUGGESTED RETAIL PRICE (MSRP). The MSRP does not include taxes, title, transportation, other options and other dealer fees and charges.
In order to complete the Pre-Order Process, you will be required to
- select a participating Dealer from which to purchase the Vehicle,
- submit certain information to MINI and the Dealer, and
- pay a refundable deposit of $159 ("Pre-Order Deposit") via one of the available methods presented by the Dealer.
Under the Pre-Order Program, after you have successfully completed and submitted the Pre-Order form, you may either purchase, finance, or lease the Vehicle from the Dealer.
The Pre-Order Program does NOT require you to complete a vehicle purchase, finance, or lease. If you change your mind, you may cancel your Pre-Order by following the process outlined below under the "ORDER CANCELLATIONS" section.
This Pre-Order Program is designed to allow you to order the Vehicle. After you place your Pre-Order request, the Dealer will contact you to configure the Vehicle. Please note that vehicle option availability may be subject to change. Model year, paint color and other options are not guaranteed and are subject to production or sales restrictions.
Once you complete the on-line transaction you will receive a "Confirmation ID." Please keep this ID until the arrival of your Vehicle. The Dealer will then contact you to complete your vehicle configuration, negotiate the price with you and obtain your place in line for your order. Your place in line will be tied to the Dealer. In the event you are unable to complete a purchase through the Dealer, please contact the Dealer to cancel the order. You can also contact MINI Customer Service at 866-275-6464 for support.
Preorder eligibility requirements are below:
- The Pre-Order Program is available only to individuals residing in the United States and Puerto Rico who are 18 years of age or older.
- The Pre-Order Program is available to businesses or corporate entities provided that you can validate your ownership of, or employment by, the relevant business or corporate entity upon MINI's request.
- Vehicles must be purchased from and delivered through an authorized, participating MINI Dealer in the United States.
- Only one Pre-Order per household is permitted. A Pre-Order may be transferred within a household provided you can provide adequate proof, as determined by MINI, in its sole discretion, that the Pre-Order holder and the transferee are part of the same household.
- If MINI determines that a Pre-Order has been placed by a non-eligible person or entity, then MINI reserves the right to cancel the Pre-Order and cancel shipment of the Vehicle. The Vehicle will then be made available to the next individual who has completed the Pre-Order Process and who has a similarly configured vehicle.

ORDER CANCELLATIONS

It is the Customer's responsibility to arrange the cancellation of the pre-order and the refund of the on-line deposit directly with the Dealer. Please note that all cancellations are final - you lose your priority to purchase one of the early production units once the order is canceled.

PRIVACY

The information collected on the Pre-Order website during your Pre-Order Process will be shared with MINI and the Dealer you select in order for us to confirm and process your Pre-Order. The handling of this information is governed by the MINI USA Privacy Policy which is available at https://www.bmwusa.com/privacy-policy/index.html. Although you will be on a MINI website, you will provide your payment information for the Pre-Order Fee directly to the Dealer through one of the payments methods the Dealer accepts. MINI never receives or holds your payment information. MINI is not responsible for any information you submit to the Dealer.

PROGRAM CANCELLATION

MINI, at its sole discretion at any time for any reason, reserves the right to cancel or change the Pre-Order Program.

Event-based interactions include MINI USA-sponsored events, test drive experiences and vehicle service requests. Each event-based interaction with MINI USA provides an opportunity to give SMS consent and requires a separate opt-out for each event. At any time, you may discontinue receiving SMS messages by sending the SMS message 'STOP' in response to the MINI USA message you received or by following other instructions provided in the last MINI USA message received for that event. PHISHING SCAMS

There is a type of e-mail solicitation commonly known as a 'phishing' scam, with the primary objective being to obtain one's personal information. This information can then be used to steal a person's identity. Examples of these types of scams are: requests for you to send passwords, login names, Social Security numbers, or other personal information through email, U.S. mail, fax or text message. MINI USA does not participate in this type of solicitation. Recipients of suspicious email like this should delete the message from their inbox and, if possible, update their e-mail filter settings to block emails from the e-mail address being used. The Federal Trade Commission and the Antiphishing Workgroup are also good sources of information about these types of security threats and how they may be reported to the authorities.

SITES TRAFFIC MONITORING

We collect information about visits to our Sites by tracking Internet Protocol (IP) addresses or other identifiers.We use this information to determine how to make future visits more convenient and productive for all MINI enthusiasts.We may also collect device type, browser type, access time, and the URL where a user is entering or exiting the Sites.
- What should I do when I have finished accessing confidential data?
  When you have finished using a secure area of the MINI USA Sites, make sure you always click on the 'Log Out' link in the upper right corner of the web page.When you click on it, you will be given the option to end your secure session.No further secure transactions can be conducted without re-entering your MINI USA Login.
- Why can I still see some of my account information even after I have left a secure area?

*MINI Accessory Wheels that are installed on/in the vehicle prior to the delivery to the client will carry the full New Vehicle Limited Warranty. If the installation is made by a Dealer after the retail sale of the vehicle, the accessory will carry the remainder of the New Vehicle/SAV Limited Warranty period or the limited parts warranty for two years from the date of installation, whichever is greater. Warranty repairs do not constitute an extension of the original limited warranty period for the vehicle or any parts (including accessories) thereof. All tires are manufactured by third parties and are covered by the limited warranty of the specific tire manufacturer. Please see an authorized MINI Dealer for information about specific tires and the tire manufacturersâ€™ limited warranty. For more information about run-flat technology, please refer to your specific vehicleâ€™s Ownerâ€™s Manual. DRIVING OVER ROUGH OR DAMAGED ROAD SURFACES, AS WELL AS DEBRIS, CURBS AND OTHER OBSTACLES CAN CAUSE SERIOUS DAMAGE TO WHEELS, TIRES AND SUSPENSION PARTS. THIS IS MORE LIKELY TO OCCUR WITH LOWâ€“PROFILE TIRES, WHICH PROVIDE LESS CUSHIONING BETWEEN THE WHEEL AND THE ROAD. BE CAREFUL TO AVOID ROAD HAZARDS AND REDUCE YOUR SPEED, ESPECIALLY IF YOUR VEHICLE IS EQUIPPED WITH LOW-PROFILE TIRES. PERFORMANCE TIRES MAY WEAR FASTER DEPENDING ON DRIVING STYLE AND DRIVING CONDITIONS AND MAY ALSO BE MORE COSTLY TO REPLACE THAN NONâ€“PERFORMANCE TIRES OF THE SAME SIZE. FOR MORE INFORMATION, PLEASE REFER TO THE TIRE MANUFACTURERâ€™S WARRANTY MANUAL PROVIDED WITH THE VEHICLE. Proof of Purchase Requirements: Purchase any eligible MINI Approved Wheel and Tire Sets from the product list on back at any Authorized MINI Dealer or on shopminiusa.com. Offer valid between 11/1/2017 and 12/31/2017. Visit MINIREBATEOFFERS.com and complete the online form or mail this completed rebate form to the address above. All submissions must include the original MINI Dealer invoice and/or repair order. Last 7 digits of your vehicleâ€™s VIN are required for all submissions. Rebate payout is $500 on wheel and tire sets listed on the eligible product list on back. Labor and/or additional dealer charges are excluded. Submit all items by 1/31/2018. No limit on quantities. While supplies last. Terms and Conditions: Purchase completed between 11/1/2017 and 12/31/2017. Requests MUST be postmarked or submitted online by 1/31/2018. Submit rebate redemption form with original MINI Dealer invoice and/or repair order. Last 7 digits of your vehicleâ€™s VIN are required for all submissions. Receive $500 off via mail-in rebate on a VisaÂ® Prepaid Card. See product list on back for eligible wheel and tire sets. Incomplete submissions will not be accepted or fulfilled. You should receive your rebate within 6-12 weeks after claim is received. All rebates will be issued in US dollars, in the form of a VisaÂ® Prepaid Card.
